THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.12165 of 2012 ORDER:

This Writ Petition was filed by two petitioners challenging the opening of rowdy sheet against them on 11.11.2008. Learned Government Pleader, on the basis of the written instructions, submits that a case in Crime No.153 of 2013 was registered against the first petitioner and he is facing trial in PRC No.6 of 2016. However, no cases are pending against him on the file of the Moghalpura Police Station, where the rowdy sheet of the first petitioner is being continued and renewed on transfer from Hussainaliam Police Station,

Hyderabad, and stood extended till 31.12.2016. So far as the second petitioner is concerned, since no cases are pending against him, the rowdy sheet was closed on 15.09.2015.

Though it is stated in the written instructions that after disposal of PRC No.6 of 2016, the first petitioner can make a representation, this Court feels that the pendency of a lone case against the first petitioner will not enable the second respondent to continue the rowdy sheet as per the Police Standing Orders.

In the circumstances, the second respondent shall review the case of the first petitioner, whose rowdy sheet was extended up to 31.12.2016, taking into consideration the pending cases, and pass appropriate orders in accordance with law, within a period of two months from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
