The de-facto complainant and her counsel Sri N.Ashok Kumar are present. Accused Nos.1 to 3 and their counsel Sri P.Prabhakar Reddy are present.
Heard both sides.
The de-facto complainant lodged FIR No.174 of 2013 before the Mandamarri PS against the accused for the offences under Sections 498A IPC and Sections 3 and 4 of Dowry Prohibition Act and investigation is stated to be pending.
While so, now the submission of both sides is that at the intervention of elders both the parties have resolved their disputes and de-facto complainant and A1 have decided to obtain divorce and already filed O.P.No.54 of 2014 on the file of Senior Civil Judge at Mancherial and the same is pending and maintenance claims of defacto complainant and her daughter-Adya are taken care in the compromise petition filed in the divorce OP and parties have also settled their disputes in respect of present criminal proceedings and therefore, permission may be accorded to them to compromise the case and record the compromise and quash the proceedings.
Having regard to the above said submission and considering the fact that it is a matrimonial case and parties have amicably resolved their disputes and no useful purpose will be served if they are forced to undergo trial since the matter was already amicably settled by them and following the decision reported in Gian Singh vs. State of Punjab and another (2012) 10 SCC 303) petition is allowed compromise is recorded in terms of accompanying compromise memo and consequently the proceedings in Cr.No.174 of 2013 of Mandamarri PS, Adilabad District are hereby quashed.
In the result, both the petitions are accordingly allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
