THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 41013 of 2015 ORDER:

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declare the action of the 3rd respondent in calling the petitioner to the police station and making him to sit in the police for hours together without there being any complaint or case registered against him and thereby causing interference with his personal life and liberty, as being illegal, arbitrary and unjust and consequently direct the 2nd respondent herein to take action against the 3rd respondent in accordance with Law for adopting illegal methods and threatening to implicate the petitioner in unconcerned case, and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case."

2. Written instructions dated 23.12.2015 were furnished by the Station House Officer, Kothur Police Station, Mahabubnagar District, denying the allegations leveled by the petitioner to the effect that the police authorities were threatening to implicate him in false cases and were interfering with his personal life and liberty. The Station House Officer stated that no crime has been registered against the petitioner and no complaint was pending against him on the file of Kothur Police Station. The question of calling him to the police station and detaining him therefore did not arise, according to him. The other allegations leveled by the petitioner to the effect that the police authorities were adopting illegal methods to extract money from the petitioner and were detaining him in the police station, were also denied.

The Station House Officer further stated that neither the petitioner nor V.Dhinkar resided within the jurisdictional limits of Kothur Police Station. The Station House Officer concluded by stating that as there was no case registered against the petitioner, the police had never made any efforts to either enquire anything from him or examine him in connection with any criminal investigation.

3. In the light of the aforestated stand of the police authorities which is taken on record, no adjudication is warranted in this writ petition and the

same is also conceded by Sri Gulam Rabbani, learned counsel for the petitioner.

The Writ Petition is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed in the light of this final order. No order as to costs.
