HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 6627 of 2016 O R D E R:- Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents.

The petitioner was appointed as Dealer of Fair Price Shop No.533 of Devender Nagar, Gajularamaram Village, Qutubullapur Mandal, Ranga Reddy District, and his authorization is valid up to 31.03.2017. While so, on 23.01.2016 the 4th respondent visited the shop of the petitioner and noticed certain irregularities and submitted a report dated 25.01.2016. Pursuant to which, the 3rd respondent issued a show cause notice on 29.01.2016 calling upon the petitioner to explain reasons as to why action should not be initiated for cancellation of his authorization, for which, the petitioner submitted his explanation on 06.02.2016. However, on 09.02.2016 the 3rd respondent suspended the authorization, till the outcome of 6-A proceedings pending before the Collector (CS), Ranga Reddy District. Challenging the same, the present writ petition is filed.

Learned counsel for the petitioner mainly submits

that against the impugned order, the petitioner preferred an appeal before the 2nd respondent on 15.02.2016 along with a stay petition and the same are still pending. This submission is not disputed by the learned Government Pleader for revenue.

In view of the fact that the petitioner preferred an appeal against the impugned order dated 09.02.2016 passed by the 3rd respondent, this Court is not inclined to consider the validity or otherwise of the said order. However, since the petitioner had already filed an appeal along with a stay petition, the 2nd respondent is directed to consider the stay petition filed on 15.02.2016 and dispose of the same within two (2) weeks from the date of receipt of a copy of this order.

The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand dismissed. There shall be no order as to costs.
