THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.8779 OF 2017 JUDGMENT: (Oral) (Per the Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, the petitioner seeks direction thereby directing the respondents No.1 to 3 to produce the person by name Sirra Lavanya, D/o Sirra Ramulu, who is in illegal detention of the respondents No.4 and 5, before this Court.

As stated in the affidavit filed in support of the present petition that the petitioner is a native place of Nellore District, who has completed his B.Tech graduation in the year 2011 at Hyderabad. He has been working in Apex Covantage India Private Limited, Hyderabad as Epub Analyst (Software). Since last two years, the petitioner and the above named girl are in love. She is also working in the same company. She is native of Warangal District and staying at ladies hostel in Hyderabad, whereas her parents are residents of Bhudharaopet village in Warangal District. The petitioner and Lavanya have decided to marry, and accordingly, they informed the same to the petitioner's mother as his father is no more, and also to the respondents No.4 and 5, who are father and elder brother of the said Lavanya. However, on 12.02.2017 at about 6.30 a.m. the respondent No.5, the elder

brother of Lavanya, came to Hyderabad and took away his sister to their native village in Warangal District.

Consequently, on 15.02.2017, the petitioner along with his brother-in-law, by name, D. Sridhar, and uncle, by name, G. Bhaskar went to Warangal and approached the respondents No.4 and 5. But they did not allow them to see Lavanya. Thereafter, on 17.02.2017, Lavanya gave a message to the petitioner through cell No.7658993813. Immediately, the petitioner made a call to the said Mobile number, then the said Lavanya answered the phone call and cried and told that she had been detained in a room by her father and elder brother i.e., respondents No.4 and 5, and putting pressure to marry another person, and requested the petitioner to come over there and release her from their clutches. 3.

Pursuant to order dated 14.03.2017, the respondents No.4 and 5 are present in the Court along with Sirra Lavanya.

4. We have interacted with the aforesaid girl in the open Court and asked whether she intends to marry the petitioner. She stated in affirmative. Since she started weeping in the open Court, then we have taken up this matter in the chamber.

5. In the chamber, we interacted with the petitioner and Lavanya. Both admitted that they are in love from the

last two years. They intend to marry. If the parents agree, they would be happy to live together in marital life.

6. Thereafter, we interacted with the father and brother of Lavanya. Both of them stated that they never posed as hurdle for the children. They state that they are searching for a good match for Lavanya and she never disclosed the fact that she has liking for the petitioner. As she disclosed this fact, there is no point in insisting her to marry someone else and spending lot of money in search of matches.

7. At last, in our chambers, the father and brother have blessed the petitioner and Lavanya and agreed that, if they are interested, they are free to marry, and assured that if any problem comes, they will come to the rescue.

8. Before disposing of this petition, we hereby say that the petitioner and the above named girl, both are majors. Both are B.Tech graduates and are serving as Data Analysts.

9. Since the mother of the petitioner is not present, we had no opportunity to interact with her. However, we interacted with the father and brother of the Lavanya. They are from a small village. All the children in their family are highly educated and we appreciate the good gesture of father and brother of Lavanya in accepting the proposal of the petitioner and Lavanya. The brother of Lavanya states that his father never discriminated between him and other

daughters and he always used to call them as sons and gave education, all facilities equivalent to his son. They have undertaken before this Court that they will not interfere with the life of the petitioner and Lavanya, and in the near future, they will perform their marriage.

10. We appreciate the attitude of the respondents No.4 and 5 and we wish a happy and prosperous future for the petitioner and his would be life partner i.e., Lavanya.

11. In view of the above, the Writ Petition is closed. There shall be no order as to costs.

Miscellaneous petitions, if any pending, shall stand closed.
