HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.26801 OF 2017 ORDER:

This writ petition is filed challenging the proceedings dated 15.07.2017 issued by the 3rd respondent on the ground that the same is issued without issuing any notice to the petitioner which is in violation of principles of natural justice. Heard learned counsel for the petitioner and Sri MSR.Chandra Murthy, learned Standing Counsel appearing for respondent No.3.

A reading of the impugned order goes to show that no notice was issued to the petitioner before the passing the said order which is in violation of principles of natural justice. Only on the ground of violation of principles of natural justice, the impugned order dated 15.07.2017 is set aside. However, this order will not preclude the 3rd respondent from passing appropriate orders after following due process of law by issuing notices to the petitioner. Accordingly, the writ petition is allowed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
