THE HON'BLE SRI JUSTICE S.V.BHATT CIVIL REVISION PETITION No.3607 of 2016 ORDER:

The prayer of revision petitioner for rejection of plaint under Order VII Rule 11 of the Code of Civil Procedure is considered by the trial Court. Having regard to the nature of defence, the trial Court has rightly refused to reject the plaint.

2. Though the counsel appearing for petitioner raised a few objections against the order impugned in the revision, this Court is of the view that if findings on these issues are considered and recorded, the same would prejudicially affect the valuable defence set up by the revision petitioner. Hence, the points raised are not considered or any view expressed. The civil revision petition fails and dismissed accordingly. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
