THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7196 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner - accused in Crime No.264 of 2023 pending on the file of Station House Officer, Shamshabad Police Station, Cyberabad, filed for the offences punishable under Sections 302 and 323 of the Indian Penal Code (for short 'IPC'). 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The case of the prosecution is that the deceased under the influence of alcohol forced the petitioner who is his wife to participate in sexual intercourse and when she refused, the deceased picked up a quarrel with her. For the said reason, petitioner took an axe and attacked the deceased on his neck and shoulder, which resulted in the death of her husband.

The petitioner was remanded to judicial custody on 30.05.2023. As seen from the remand report, all the material witnesses were examined and major part of investigation is complete and the same is not disputed by the learned Additional Public Prosecutor. In the said circumstances, the petitioner can be granted the relief of regular bail subject to conditions. 5.

Accordingly, the Criminal Petition is allowed and the petitioner-accused is granted bail subject to the following conditions: i) The petitioner - accused shall execute a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of learned XI Additional Chief Metropolitan Magistrate, Cyberabad at Rajendranagar.

ii) The petitioner - accused shall appear before the investigating authorities as and when required for the purpose of investigation.

iii) The petitioner - accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
