No representation for petitioners.
The petitioners pray for the following relief: "...this Hon'ble Court may be pleased to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus by declaring the action of the 1st respondent herein in interfering with the civil rights of the petitioners over the petition schedule property to an extent of Ac.43-863⁄4 cents in Nekkundi survey group situated at K.Batthalapuram Village, Nekkundi Grampanchayat, Punganur Mandal, Chittoor District at the instance of respondents 1 to 4 herein as illegal, void and capricious and consequently direct the 1st respondent herein not to interfere with the civil litigation between the petitioners and the respondents 2 to 4 in pending suit in O.S. No.107 of 2010 on the file of the Senior Civil Judge, Punganur, Chittoor District and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
The grievance of the petitioners is that the respondents are interfering in civil dispute.
The 1st respondent filed counter affidavit and the relevant portion therein reads thus:
"It is pertinent to submit that as of now, no complaint whatsoever is received or registered against the petitioners herein on the file of Punganur Police Station. It is respectfully submitted that this respondent never interfered with the subject lands of the petitioners and never threatened them as alleged. I humbly submit that this respondent never summoned the petitioners to the police station. I humbly submit that to settle their personal scores with the unofficial respondents herein, the petitioner
made baseless allegations against this respondent which are far from truth.
I humbly submit that this respondent never interfered with the civil disputes much less the dispute of the petitioner herein. Hence, the writ petition is devoid of any merits.".
The stand of respondent No.1 is placed on record. The writ petition is, accordingly, dismissed. There shall be no order as to costs.
