THE HONOURABLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No. 8974 OF 2015 ORDER:

This Criminal petition is filed by the petitioner under Section 482 of the Criminal Procedure Code, 1973 seeking to quash the investigation in Crime No.37 of 2013 of Gopalpet Police Station, Mahabubnagar, Mahabubnagar District, which was registered on the report of the respondent No.2/ de facto complainant against the petitioner and other accused for the offence punishable under Sections 324, 325, 504 read with 34 of the Indian Penal Code, 1860, Heard learned counsel for the petitioner/ A.2 and the learned Public Prosecutor for Telangana State / respondent No.1.

It is the submission of learned Public Prosecutor that police filed final report that was taken cognizance and numbered as C.C.

Having regard to the above submission, the criminal petition is disposed of giving liberty to the petitioner to file fresh petition impugning cognizance taken by the learned Magistrate along with necessary material including part II.
