IN THE HIGH COURT OF JUDICATURE AT HYDERABAD

FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) THURSDAY, THE TWENTY EIGHTH DAY OF MAY TWO THOUSAND AND FIFTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR AND THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT APPEAL No.399 of 2015 BETWEEN N.Rajesh Kumar ... PETITIONER AND State of Telangana, rep. by its Principal Secretary and others ...RESPONDENTS The Court made the following:

ORDER: (Per VVA, J) This appeal is directed with the grievance that no orders were passed by the learned single judge in WP MP No.1862 of 2015 in WP No.14346 of 2015. Learned counsel for the petitioner contends that though a seat was reserved for the petitioner by order of the learned single Judge in W.P.No.14346 of 2015, dated 14.05.2015, he is not been permitted to appear for the second counseling scheduled on 30.05.2015. Though we have heard learned counsel for the appellant and learned standing counsel for the respondents, we are unable to entertain the writ appeal as no orders are passed by the learned single Judge in WP MP No.1862 of 2015. Consequently, therefore, there is no judgment, which can be impugned under clause 15 of the Letters Patent Appeal, following the ratio of the Supreme Court reported in {Shah Babulal Khimji v. Jayaben [AIR 1981 Supreme Court 1786]}.

Writ petition is, accordingly, dismissed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
