Heard learned counsel for the parties.
This writ appeal is directed against the interim order dated 12-10-2015 passed in WPMP No.41914 of 2015 in Writ Petition No.32430 of 2015 whereby the ad-interim order granted on 03-10-2015 has been vacated.
This Court on 14-10-2015 declined to grant any relief. The order dated 14-102015 was then carried by the appellant to the Supreme Court in SLP No. 19152 of 2015. The Supreme Court on 16-10-2015 dismissed the SLP with liberty to the appellant to approach this Court for appropriate redress, if so advised in accordance with law.
Learned counsel for the appellant submits that after filing of the writ petition and in view of the subsequent developments, the appellant has made representation dated 20-10-2015 to the Ministry of Petroleum and Natural Gas, Shastri Bhavan, New Delhi and that the representation is pending consideration. He submits that the appellant may be permitted to withdraw the writ petition as well as the writ appeal and directions may be issued to the Ministry of Petroleum and Natural Gas to consider and decide their representation within time frame. Learned counsel appearing for the respondents do not have any objection for issuing such direction and even for withdrawal of the writ petition and the writ appeal.
Hence, we pass the following order:
"Writ petition and writ appeal are allowed to be withdrawn and disposed of as such. Ministry of Petroleum and Natural Gas shall endeavour to consider and decide the appellant's representation dated 20-10-2015, as expeditiously as possible and preferably within a period of 12 weeks from today. The appellant is directed to communicate this order to the concerned Ministry within a period of ten days from today. It is made clear that while passing this order we have not examined merits of the case. All contentions of the parties are kept open." Miscellaneous petitions, if any, pending in the writ petition and the writ appeal also stand disposed of.
