THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 20152 of 2019 ORDER:

This Writ Petition is filed for the following relief: "For the aforesaid reasons that this Hon'ble Court may be pleased to issue a Writ in the nature of Writ of Mandamus or an appropriate Writ or order or direction to the Respondents holding that the action on the part of the Respondents, in "Declining" to sanction ex gratia relief, through Govt.Memo No.523/DM-I/A1/2019, dated 31.05.2019 to the Petitioner herein, for the death of her husband 01.10.2016 due to "Thunderbolt", despite of the finality of the Orders of the Hon'ble High Court of Judicature, Hyderabad issued in W.P.No.1799 of 2019 dated 06.02.2019 holding that G.O.Ms.No.1, Revenue (D.M-I) Department, dated 04.05.2015 squarely covered under SDRF Rules notified by the Government of India and the victim's family would be entitled to ex gratia as per the said G.O.Ms.No.

1, Revenue (D.M-I) Department, dated 04.05.2015, as illegal, arbitrary and violation of fundamental rights guaranteed under the Constitution and the same may be set-aside. Consequently direct the Respondents to pay ex gratia of Rs.5,00,000/- (Rupees Five Lakhs only) to the Petitioner herein, within a time bound period."

When the matter is taken up, it is submitted by the learned counsel for the petitioner that the issue in the present Writ Petition is squarely covered by the order dated 06.02.2019 passed by this Court in Writ Petition No.1799 of 2019.

CKR, J W.P.No.20152 of 2019 Learned Government Pleader for Revenue does not dispute the aforesaid submission.

In those circumstances, following the above said order and for the reasons recorded therein, this Writ Petition is also disposed of in terms thereof.

Office to annex a copy of the order dated 06.02.2019 passed by this Court in Writ Petition No.1799 of 2019 to this order.

Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
