Sy.No,44, Janachaitanya Colony, Miyapur, Serilingampally, Hyderabad, as illegal, arbitrary, unconstitutional and violative of Articles 14 and 21 of the Constitution of lndia and consequently direct the respondents to register an FIR on the petitioner's complaint dated 03,06.2026, conduct a fair, impartial and time-bound investigation, take appropriate criminal action against the accused persons in accordance with law.

ORDER
This Writ Petition is filed alleging inaction on the part of the respondents in taking action on the complaint submitted by the petitioner on 03.06.2026 regarding the incident of criminal trespass, assault, mischief, theft, damage to property, and criminal intimidation committed by the certain private persons at the petitioner's business premises, namely "AR Refreshing Zone", situated at Plot No.63, Sy.No.44, Janachaitanya Colony, Miyapur, Serilingampally, Hyderabad.

Heard Sri V. Arvind, leamed counsel representing learned counsel for the petitioner and leamed Assistant Govemment Pleader for Home appearing for the respondents. 3.
Sri V. Arvind, learned counsel representing learned counsel for the petitioner, submitted that,, the petitioner is carrying on business under the name and style of "M/s. AR Refreshing Zone" at Miyapur. It is submitted that, on 03.06.2026, a group of persons unlau.fully trespassed into the said premises, assaulted the petitioner's lamily members and staff, damaged CCTV cameras, furniture and other business assets and removed certain articles, thereby causing a loss estimated at about Rs.29,70,000/-. Leamed counsel for the petitioner further submitted that the petitioner has lodged a complaint and submitted representations to the police authorities, but no FIR has been registered or investigation initiated. Aggrieved by the said inaction of the respondent authorities, this Writ Petition is filed.

Leamed Assistant Government Pleader for Home, appearing for the respondents, submitted that in respect of the very same
TMD.J wP 1835 r 2026 J incident that occurred on 03.06.2026 at the business premises of the petitioner,, the petitioner's father had already lodged a complaint alleging criminal trespass and assault and pursuant thereto, a case was registered as Crime No.847l2026 dated 04.06.2026 under Sections 3299), 115(2) and 324 (2) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS'). It is further submitted that the petitioner had also given a complaint with regard to the trespass, assault, theft and damage to the property.

Learned Assistant Government Pleader further submitted that on the receipt of the complaint of father of the petitioner a Crime No.847 of 2026 is registered and during the course of investigation, the statement of the petitioner would also be recorded and thorough investigation would be made. 6.
Having regard to the above submissions, this Court is of the opinion that both the complaints arise out of same incident but the recitals in the complaint with regard to the damage of the property are specifically reflected in the complaint lodged by the petitioner ln such circumstances, the respondent police ought to have clubbed
TMD,J wP 18351 2026 both the complaints and conducted investigation into all the allegations arising out of the same incident. Therefore, this court deems it fit and proper to dispose of this Writ petition at the admission stage with a direction to the respondents to club the complaint of the petitioner with the complaint of the father of the petitioner registered as crime No.g47 of 2026 and thereafter, conduct investigation on all the allegations made therein, including those relating to theft and damage to property, in accordance with law. There shall be no order as to costs.

Miscellaneous applications, if any, pending shall stand closed.
