HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.24187 of 2017 ORDER:
Heard the learned counsel for the petitioners and also Sri Abhisekh Reddy, learned standing counsel for the 1st respondentJNTU and before ordering notice to the 2nd respondent and perused the prayer in the writ petition with the supporting affidavit and the other material on record.
The prayer in the writ petition reads as follows: "To issue a direction, order or writ more particularly one in the nature of writ of mandamus declaring the action of the 1st respondent in not allowing the petitioners to write the exams of VIII Semester of IV year course commencing from 01.08.2017 onwards as arbitrary and illegal and consequently direct the respondents to permit the petitioners to pursue their entire course of Bachelor of Architecture and pass such other order or orders." As per the guidelines without completion of first year subjects a student shall not be permitted to write examinations of 4th year. The petitioners appeared in the supplementary examinations of the backlog subjects of the first year conducted in March 2017 and the results are not declared so far and had it been they could have been passed and they could be eligible to write the exams of VIII Semester of 4th year commencing from 01.08.2017 and it is the non-declaration of results that affects their career and they have performed well in the supplementary exams of March 2017.
Having regard to the above and in the result, the Writ Petition itself is disposed of directing the respondents to permit the petitioners to write the exams of VIII Semester of 4th year course commencing from 01.08.2017, which is no doubt subject
Dr. SSRB,J to the declaration of the results of the backlog subjects of first year conducted in March 2017 and in the event of their pass from their eligibility they could get by now and if they fail in supplementary exams, the present permission by virtue of this order will not get any type of eligibility in their favour to take benefit of it.
Consequently, miscellaneous petitions, if any, shall stand closed. No costs.
