THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.526 OF 2016 ORDER:

Heard learned Additional Public Prosecutor for the petitioner State, learned counsel for respondents/A.12 to A.17 and perused the record.

This petition is filed under Section 439(2) Cr.P.C. for cancellation of bail granted to the respondents/A.12 to A.17 vide order dated 28.12.2015 in Crl.M.P.No.1689 of 2015 in Crime No.393 of 2015 on the file of the Principal Sessions Judge, Khammam.

As per the material placed on record, the bail was granted to the respondents in the year 2015 on some conditions. Now, it is brought to the notice of this Court that after filing this petition, respondents/A.12 to A.17 have been cooperating with the investigating officers. As the call data was not collected from the authorities concerned, there is a delay in filing the charge-sheet. Pursuant to the order of this Court dated 06.12.2017, the Station House Officer is present. As there is no violation of the terms and conditions of the bail granted to the respondents/A.12 to A.17, as they are cooperating with the investigating officers and as most part of the investigation is completed, I see no justifiable ground to allow this petition.
