HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY W.P. No. 16976 of 2017 O R D E R:- This writ petition is filed to declare the action of the respondents in interfering to take possession of the Plot bearing Nos. 47 and 48, total admeasuring 234.0 square yards or equivalent to 195.62 square metres, in Sy.No. 192, Ganesh Nagar situated at Quthbullapur village & Gram Panchayat, Quthbullapur Mandal, Quthbullapur Circle, Ranga Reddy District, as arbitrary, illegal and violative of principles of natural justice and consequently direct the respondents not to interfere with the possession of the petitioner's open Plot Nos.47 and 48 in Sy.No.192, Ganesh Nagar, Quthbullapur Circle, Ranga Reddy District.
During hearing, Sri Chatla Madhu, learned Standing Counsel for Greater Hyderabad Municipal Corporation appearing on behalf of respondent Nos.2 to 4, has submitted that they have taken only measurements of the plots belonging to the petitioner, but have not proposed to demolish any part of the constructions made therein, without issuing notice to the petitioner.
In view of the above submission, the respondents are directed to not to take coercive measures to demolish any part of the constructions raised in Plots bearing Nos. 47 and 48 admeasuring 234.0 square yards without following due process
MSM,J WP_16976_2017 of law. However, liberty is given to the respondents to take appropriate steps in accordance with law.
With the above direction, the writ petition is disposed of. No order as to costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
