THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26184 of 2009 ORDER:

This writ petition is filed challenging the final order, dated 11.11.2009, passed by the District Registrar, Hyderabad (South), impounding a document by treating it as a sale deed under Article 47-A of Schedule 1-A of the Indian Stamp Act and asking the petitioner to pay the deficit stamp duty and penalty. Learned counsel for the petitioner submitted that the client took away the bundle in 2010 itself and he has no instructions to appear in the matter.

Today, when the case is called, none else entered appearance and argued the matter. In the circumstances, this Court is constrained to dismiss the writ petition for non-prosecution.

The Writ Petition is accordingly dismissed for non-prosecution.
