THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.21680 of 2002 O R D E R:

This writ petition is filed seeking a writ of Mandamus to declare the Award of the 1st respondent passed in I.T.I.D. No.45 of 1998 dated 5.2.2001 as arbitrary and illegal.

When the matter is taken up for hearing, it is noticed that the writ petition against the 2nd respondent-workman was dismissed vide orders dated 18.8.2010 and no steps were taken by the petitioners to restore the writ petition against the 2nd respondent-workman. The award passed in I.T.I.D. No.45 of 1998 was in favour of the 2nd respondentworkman. In the absence of 2nd respondent-workman, the cause in the writ petition cannot be adjudicated.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.
