THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.3297 OF 2016

O R D E R

The grievance of the petitioner is with regard to the failure on the part of the mining authorities to grant renewal of his mining lease over an extent of Ac.71.43 cents in Vemula and Kathalur Villages, Pulivendula Mandal, Kadpa District.

Written instructions dated 18.02.2016 were furnished by the Assistant Director of Mines and Geology, Yerraguntla, to the office of the learned Government Pleader for Industries and Commerce, wherein he stated that after the conversion of the mineral 'Barytes' into a minor mineral, orders were still awaited from the Government as regards the petitioner's application for renewal.

In the light of the aforestated instructions, this Court is of the opinion that there is no purpose served in entertaining this writ petition or adjudicating it on merits. As the authorities concerned are yet to apply their mind to the petitioner's request for renewal of his mining lease and as it is not open to the authorities to keep such an application pending indefinitely, the writ petition is disposed of directing the authorities concerned to consider the petitioner's representation dated 22.06.2015 for renewal of his mining lease and take appropriate action thereon in accordance with law. In the event the petitioner's request is rejected, the reasons therefor shall be recorded and duly communicated to him. This exercise shall be completely expeditiously and in any event, not later than two months from the date of receipt of a copy of this order. Pending miscellaneous petitions shall stand closed. No order as to costs.
