HON'BLE SRI JUSTICE SURESH KUMAR KAIT CIVIL REVISION PETITION No.3508 of 2018 ORDER : (Oral) Vide the present petition, the petitioner has challenged the order dated 5th March 2018, whereby, the petition filed under Section 45 of the Indian Evidence Act to send the alleged promissory note dated 15th January 2014 i.e. Ex.A-1 in O.S.No.178 of 2016 on the file of I-Additional Junior Civil Judge, Guntur, to the Handwriting Expert for comparison of the petitioner/defendant's signature, has been dismissed. Learned counsel appearing on behalf of the respondent herein submits that he has no objection if the present revision petition is allowed.

Keeping in view the averments made in the instant petition and the concession granted by the counsel for respondent, I hereby set aside the order dated 5th March 2018.

Consequently, the trial Court is directed to send the promissory note dated 15th January 2014 i.e. Ex.A-1 in O.S.No.178 of 2016 to the Handwriting Expert for comparison.

The revision petition is accordingly disposed of. No order as to costs.
