THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.17030 OF 2016 ORDER:
This Criminal Petition, under Section 482 of Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed to quash the proceedings against the petitioners in C.C. No.198 of 2016 pending on the file of Special Judge for Economic Offences at Hyderabad, on various grounds.
It is averred at paragraph 10 of the criminal petition that the petitioners appeared before the Court on 15.11.2016 and the learned Special Judge insisted to furnish two sureties for Rs.10,000/- for each of the petitioner.
But due to demonetization, the petitioners could not comply the direction. During hearing, learned counsel for the petitioners drawn the attention of this court about the difficulty in furnishing salary certificates of 72 employees, as sureties. Taking into consideration of the difficulty expressed by the petitioners, I deem it appropriate to request the Special Judge for Economic Offences at Hyderabad to accept the Bank guarantee without insisting for furnishing of two sureties for Rs.10,000/- for each of the petitioner in C.C. No.198 of 2016. Accordingly, the criminal petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
