ORDER

This writ petition is filed seeking to declare the action of the 3rd respondent in calling the petitioners to the 3rd respondent-police station and making them sit for hours together without considering the complaints made by the 1st petitioner on 24.08.2016 & 10.12.2016 as arbitrary and illegal. Learned Government Pleader, on written instructions, submits that on the complaint lodged by the 5th respondent on 12.12.2016, Cr.No.624 of 2016 was registered and investigation was taken up. But, so far, no clues have been detected. Since the complainant suspected her husband's brother and mother, who are none other than the petitioners herein, police tried to examine them in the process of further investigation, but they are not co-operating. Knowing fully well about registration of crime against them, the petitioners filed the present writ petition.

Since the said instructions revealed that the presence of the petitioners is required for the purpose of investigation, the 3rd respondent is directed to follow due process of law, if the presence of the petitioners is required in connection with the crime already registered.

Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
