THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7220 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime No.58 of 2023, on the file of Chinthalamanepally Police Station, Koutala Circle, Komarambheem Asifabad District, registered for the offences under Sections 417, 420, 312, 506, 376 (2) (n) of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The de-facto complainant lodged a complaint on 12.06.2023 alleging that she knew this petitioner for the past five years. They fell in love. They had physical relation over a period of five years. However, the petitioner had stopped talking to her and was avoiding her. When enquired, it came to the knowledge of the

de-facto complainant that he was marrying another woman. When she confronted the petitioner regarding marriage, he stated that he would marry her and also tied a yellow thread (mangalsutraam) around her neck. 4.

Learned Additional Public Prosecutor on instructions would submit that the investigation is complete and charge sheet is already filed.

From the contents of the complaint, it appears that the de-facto complainant had filed the complaint for the reason of refusal by the petitioner to marry her. However, relationship between them was consensual over a period of five years, this Court deems it appropriate to grant the relief of bail to this petitioner subject to following conditions:

i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of Principal Sessions Judge, Asifabad.

ii) The petitioner/Accused after release shall appear before the concerned Station House Officer on every date of hearing.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
