THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.26892 of 2009 ORDER:
This writ petition was filed assailing the action of the respondent authorities in laying a road through the lands belonging to tribals in Chintapally Mandal, Visakhapatnam District.
By order dated 09.12.2009, this Court directed the respondent authorities not to interfere with the possession of the petitioners over the lands owned by them in Chintapally Mandal of Visakhapatnam District without following the due process of law. Despite the lapse of nearly six years, the respondent authorities have not chosen to file a counter-affidavit.
Sri P. Punna Rao, learned counsel for the petitioners, states that pursuant to the interim order, no steps were taken by the respondent authorities to interfere with the petitioners' possession over the subject lands.
In that view of the matter, this Court sees no reason to keep this matter pending awaiting a response from the respondent authorities. The writ petition is accordingly disposed of directing the respondent authorities not to interfere with the lands in question or lay a road through the said lands except by following the due procedure laid down by law.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTICE SANJAY KUMAR 9th September, 2015 IBL
