HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 22369 of 2017 Order:

This Writ Petition is filed challenging the endorsement made by the District Supply Officer, Chittoor directing the petitioner to deposit an amount of Rs.5,00,000/- in the bank account of the Joint Collector (CS), Chittoor and submit the deposit receipt in original for release of Lorry bearing No.AP 26 Y 3297 pursuant to the directions issued by the Commissioner of Civil Supplies in the claim petition filed by the petitioner dated 15.02.2017.

The petitioner states that he is not in a position to furnish the said security and this Court on earlier occasions allowed furnishing of personal security bond for release of the vehicles. But, the learned Government Pleader, on the other hand, submitted that in subsequent orders, this Court insisted for sufficient bank guarantee for release of the vehicle. In the circumstances, the endorsement given by the District Supply Officer, Chittoor is modified by giving opportunity to the petitioner to furnish bank guarantee for the amount of Rs.5,00,000/- (Rupees Five Lakhs only) for release of the Lorry bearing No.AP 26 Y 3297. As and when the petitioner furnishes the bank guarantee, the said lorry shall be released subject to the pending proceedings.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
