HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION No.2043 OF 2016 ORDER:

The present Civil Revision Petition is filed, under Article 227 of the Constitution of India, by the petitioners - plaintiffs, challenging the judgment, dated 15.12.2015, passed in C.M.A. No.24 of 2015, by the II Additional District Judge, Visakhapatnam, whereby the appeal preferred by the defendants was allowed setting aside the order, dated 29.06.2015, passed by the Principal Senior Civil Judge, Gajuwaka in I.A. No.5 of 2015 in O.S. No.7 of 2015 filed by the petitioners - plaintiffs under Order XXXIX, Rules 1 and 2 of the Code of Civil Procedure, 1908, granting temporary injunction.

2. As per the material placed before this Court, during pendency of the present revision, the original suit bearing No.7 of 2015, itself was decreed with costs, on contest. Therefore, nothing remains to be adjudicated by this Court.

3. Accordingly, the Civil Revision Petition is dismissed as infructuous. No order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in the present revision, stand closed.
