THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 13795 of 2015 ORDER:

The petitioner challenges the notice dated 16.04.2015 wherein three days time was given to her to handover the excess land in her possession.

Briefly, the case of the petitioner is that she is a landless poor and considering her eligibility, the respondent authorities granted house site patta over an extent of Ac.0-021⁄2 cents in Rapthadu village and Mandal, Ananthapur district, vide proceedings dated 10.10.2007. While so, the 4th respondent issued the impugned notice stating that she has occupied excess land over and above what has been assigned to her and hence directed her to surrender the excess land in her possession.

3. Heard learned counsel for the petitioner and the learned Government Pleader.

4. If the petitioner has not occupied any excess land, it is always open to her to make an application/representation and raise objections. But the petitioner has not done so. However, considering the fact that as on today there is no order passed by the Tahsildar, liberty is given to the petitioner to file representation raising her objections within a period of four weeks from the date of receipt of a copy of this order. Upon filing such a representation, the 4th respondentTahsildar shall consider the objections and pass appropriate orders, in accordance with law. Till such time orders are passed on the representation to be filed by the petitioner, no coercive action shall be taken by the respondent authorities.

5. Accordingly, the writ petition is disposed of. No costs. Pending miscellaneous petitions shall stand closed.
