This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused No.1 seeking to enlarge him on bail in S.C. No.387 of 2023 on the file of learned Special Sessions Judge for Trial of Offences under SCs & STs (POA) Act-cum-VII Additional District and Sessions Judge, Ranga Reddy at L.B.Nagar. The offences alleged against the petitioner is punishable under Section 302, 201 read with 109, 202 of I.P.C. and Section 3 (2) (V) of the SCs/STs (POA) Amendment Act, 2015.

The brief facts of the case are that on 24.02.2023, the petitioner voluntarily surrendered before the Abdullapurmet police
- 2 - and stated that as the deceased was interfering in his love life with his girl friend, he murdered the deceased by taking him to the nearby bushes at the outskirts of Pedda Amberpet Municipality on 17.02.2023. Hence, a case was registered vide Crime No.119 of 2023 before the Abdullapurmet Police, Vanasthalipuram and after completion of the investigation, a charge sheet was filed vide S.C.No.387 of 2023 on the file of the Special Sessions Judge for Trial of Offences under SCs & STs (POA) Act-cum-VII Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar, for the offences punishable under Sections 302, 201 read with 109, 202 of the IPC and Section 3 (2) (V) of SCs &STs (POA) Act. 3.
Heard Sri P.Prabhakar Reddy, learned counsel appearing for the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.
The learned counsel for the petitioner submits that the petitioner was studying III year B.Tech (ECE) at Aurora's Technological and Research Institute, Parvathapur, Uppal, Medipalli Mandal, Medchal-Malkajgiri District, Hyderabad, at the time of alleged incident. After his arrest, he could not continue his studies as he has been in judicial custody. It is further submitted that the petitioner has backlog subjects in I year I and II semesters, and in order to complete his B.Tech course, he paid the
- 3 - requisite examination fee and was issued Hall Ticket No. 19841A04B3. The supplementary examinations for the said subjects are scheduled from 17.06.2026 to 24.06.2026. It is also submitted that the petitioner was earlier granted interim bail by this Court in Crl.P.No.7176 of 2026, by order dated 06.05.2026, to attend the II year I and II semester supplementary examinations held from 27.04.2026 to 20.05.2026. Therefore, it is contended that unless the petitioner is granted bail to attend the I year I and II semester supplementary examinations, he will suffer irreparable loss and injury. Hence, prayed this Court to grant bail to the petitioner.

Learned Additional Public Prosecutor has not opposed the same of granting interim bail to the petitioner for enabling him to appear for his B.Tech I year I and II Semester Supplementary Examinations.

Considering the submissions made by both parties, and in view of the fact that the I year B.Tech I and II Semester supplementary examinations of the petitioner were scheduled from 17.06.2026 to 24.06.2026, and that the petitioner has already missed one examination held on 17.06.2026, this Court is inclined to grant interim bail to the petitioner from 18.06.2026 to 24.06.2026, subject to the following conditions:
- 4 - (i) The petitioner shall be released on interim bail from 18.06.2026 to 24.06.2026 subject to execution of personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the Superintendent, Central Prison, Cherlapally, Medchal Malkajgiri District.
(ii) The petitioner shall surrender before the concerned Jail Superintendent on 25.06.2026 by 10.00 a.m. (iii) The concerned Jail Superintendent is directed to ensure that this order is complied forthwith. (iv) The petitioner shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (Presently Section 480 (3) of the BNSS).
(v) Registry is directed to communicate this order to the concerned Jail Superintendent.
