When the matter is called, the learned counsel for the petitioner seeks to permit him to withdraw the petition.

Accordingly, this Civil Revision Petition is dismissed as withdrawn with liberty to the petitioner to file a suit for declaration of title, uninfluenced by any of the observations in the amendment dismissal petition, to entertain the suit if otherwise in order. As a sequel, miscellaneous petitions pending, if any, in this Revision shall stand closed. No order as to costs.
