B.Vasantha Lakshmi, learned Legal Aid Counsel, has filed Crl.A.No. 199 of 2011 on behalf of the appellant - accused against the judgment dated 26.06.2010 delivered in S.C.No. 314 of 2009 on the file of the Court of III Additional Sessions Judge (Fast Tract Court), Nizamabad and Sri Brahmadandi Ramesh, Advocate, who has been engaged by the same appellant, has filed another appeal i.e. Crl.A.No. 1028 of 2011 against the same judgment.

The learned counsel appearing in Crl.A.No. 1028 of 2011, on instructions, submits that he will argue the case on behalf of the appellant.

In such a situation, Smt. B.Vasantha Lakshmi, learned Legal Aid Counsel, has sought permission of this Court to withdraw the Crl.A. No. 199 of 2011.

Permission is accorded.

Hence, Criminal Appeal No. 199 of 2011 is dismissed as having been withdrawn in view of the fact that another appeal of the same appellant is on board.

As a sequel, the Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
