THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA F.C.A.Nos.170 AND 188 OF 2014 AND F.C.A.MP.No.536 OF 2015 COMMON JUDGMENT: (Per Hon'ble Sri Justice R. Subhash Reddy) These appeals, under Section 19 of the Family Courts Act, 1984, are filed aggrieved by the common order, dated 24.06.2014, passed in F.C.O.P.Nos.313 of 2012 and 737 of 2013 by the Family Court, Secunderabad.

The appellant - husband has filed F.C.O.P.No.313 of 2012, under Section 10 (1) of the Hindu Marriage Act, for judicial separation, whereas the respondent - wife has filed F.C.O.P.No.737 of 2013, under Section 9 of the Hindu Marriage Act, for restitution of conjugal rights. The Family Court, by impugned order, dated 24.06.2014, while allowing the O.P. filed by the respondent - wife, dismissed the O.P. filed by the appellant - husband.

During pendency of the appeals, the appellant has filed F.C.A.MP.No.536 of 2015 seeking to dispose of the appeals in terms of the compromise arrived at between the parties. When the matters are called, the parties, who are present in person and who have been identified by their respective counsel, have stated that the dispute between them is settled amicably and requested to dissolve the marriage performed between them subject

to the terms and conditions as stated in the Joint Petition annexed to F.C.A.MP.No.536 of 2015.

In view of the reasons stated in the affidavits filed in support of F.C.A.MP.No.536 of 2015, the petition is allowed as prayed for and consequently, the appeals are allowed by setting aside the impugned order, dated 24.06.2014, and by dissolving the marriage performed between the appellant and the respondent subject to the terms and conditions mentioned in the Joint Petition annexed to F.C.A.MP.No.536 of 2015. The Joint Petition shall form part of the decrees.

Miscellaneous Petitions, if any, pending in these appeals shall stand closed. No costs.
