THE HON'BLE SRI JUSTICE M.S.K. JAISWAL TRANSFER CRIMINAL PETITION No.140 of 2016 ORDER:

This petition is filed under Section 407 of the Code of Criminal Procedure, seeking transfer of C.C.No.140 of 2016 on the file of Principal Junior Civil Judge, Bhimavaram, West Godavari District, to any other Court having jurisdiction in Hyderabad.

Heard.

The petitioner herein is arrayed as accused in the above said C.C. filed under Sections 138, 141 r/w 142 of the Negotiable Instruments Act. This Court ordered notice to respondent No.2 on 29.04.2016. Though the notice was sent to the address of respondent No.2 as mentioned in the complaint, the same was returned with endorsement stating that no such person is residing at the given address.

Having heard the learned counsel for the petitioner and perusing the record, I feel that the interest of justice would be met if the Transfer Criminal Petition is ordered as prayed for.

Accordingly, the Transfer Criminal Petition is allowed and C.C.No.140 of 2016 on the file of Principal Junior Civil Judge, Bhimavaram, West Godavari District, is hereby withdrawn and transferred to the file of XIX Additional Chief Metropolitan Magistrate, for disposal of the same in accordance with law. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
