THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 20205 of 2019 O R D E R:

The petitioners claim succession to the subject land in survey Nos.68 and 69 of Bussapur Village, Mendora Mandal, Nizamabad District. One prerequisite for consideration of the claim under succession, for entries in the revenue records and issuance of pattadar pass books is an application to be filed in Form 6 (A). The applications of this nature are required to be considered under Section 4 of the Telangana Rights in Land and Pattadar Passbooks Act, 1971 and the Rules made thereunder.

As on the date of filing of the present writ petition, the petitioners had not filed any application in Form-VI (A), as such, non-consideration of their case on mere application cannot be found fault with. However, learned counsel for the petitioners submits that the petitioners submitted an Application in Form-VI (A) on 18.09.2019. Inasmuch as the petitioners had submitted the Application in the prescribed format i.e., Form VI (A), the writ petition is disposed of with the direction to respondent No.4-Tahsildar, Mendora Mandal, Armoor Division, Nizamabad District to consider the same and pass appropriate orders, within a period of three months from today, after affording an opportunity to the petitioners and other interested persons, if any.

With the above direction, the Writ Petition is disposed of. No costs.
