B.Hari Prasad v. The State Of A.P.
THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1335 OF 2015 ORDER:
This Criminal Revision Case is filed by the accused No.1 to 3 challenging the order of the Judicial First Class Magistrate at Gooty dated 02.06.2015 whereby the learned Magistrate dismissed Crl.M.P.No.2512 of 2014 in C.C.No.277 of 2013 filed by the petitioners to discharge them the said case. After arguing for some time, the learned counsel for the petitioners confined his argument to the extent of dispensing with the presence of the petitioners before the trial Court. Being the offence alleged against the petitioners under Section 498-A IPC, the question of their identity before the trial Court does not arise. In the circumstances, the presence of the petitioners before the trial Court is dispensed with except on the dates so specifically the trial Court insists for their appearance. The petitioners are directed to be represented by a counsel on all hearing dates.
The Criminal Revision Case is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
