THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.25643 of 2011 ORDER:

The grievance of the petitioner in this writ petition was that the Station House Officer, Narasannapeta Police Station, Srikakulam District, was continuously calling him to the police station and threatening to register cases against him.

The Sub-Inspector of Police, Narasannapeta Police Station, Srikakulam District, filed a counter-affidavit stating that Crime No.149 of 2009 was registered against the petitioner under Section 9-B(1)(b) of the Explosives Act, 1884 in connection with his illegal possession of explosives. However, the case ended in the petitioner's acquittal in C.C.No.3 of 2010 on the file of the learned Judicial Magistrate of First Class, Narasannapeta.

The Sub-Inspector further stated that the petitioner was not required in any criminal case thereafter and therefore the question of calling him to the police station did not arise. No reply affidavit has been filed rebutting the aforestated counteraffidavit averments. In the light of the stand put forth by the police authorities to the effect that they were not calling the petitioner to the police station as his presence was not required in any criminal investigation, no interference is warranted in this writ petition.

The writ petition is accordingly closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
