HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3116 OF 2017 ORDER:

The case of the petitioner is that the 4th respondent passed order dated 19.01.2017 under Section 6 of the A.P.Land Encroachment Act, 1905, for eviction of the petitioner from the subject land. Against the same, petitioner preferred appeal before the 2nd respondent-District Collector on 27.01.2017 along with stay petition. But, no orders are passed till today. Pending the said appeal, the respondents are trying to evict the petitioner from the subject land. Aggrieved by the same, present writ petition is filed.

Heard both sides.

Since it is stated that petitioner filed appeal before the 2nd respondent, the 2nd respondent is directed to dispose of the appeal filed by the petitioner, within a period of two months from the date of receipt of a copy of this order. Till disposal of the appeal, Status quo obtaining as on today shall be maintained.

Accordingly, the writ petition is disposed of. No order as to costs.
