THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.547 of 2012 JUDGMENT:

This appeal is filed by the defendant, under section 100 CPC, assailing the judgment and decree dated 19.11.2011 in A.S.No.86 of 2004 on the file of VIII Additional District Court (FTC), at Vijayawada, wherein whereby the decree and judgment dated 16.07.2004 in O.S.No.676 of 2002 on the file of Principal Senior Civil Judge Court, Vijayawada, dismissing the suit filed by the plaintiffs for declaration, was confirmed.

At the time of hearing, learned counsel for the appellant submitted that the parties in this appeal and in S.A.No.506 of 2012 are one and the same. He further submitted that the parties have entered into a compromise in S.A.No.506 of 2012. He also submitted that in view of the compromise arrived at between the parties, no further orders are necessary in this appeal. 3.

In view of the submission made by the learned counsel for the appellant, the second appeal is closed. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
