HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.18985 of 2016 Order:
This Writ Petition is filed challenging the action of the fifth respondent in not implementing the proceedings dated 18.03.2016 of the fourth respondent.
The fourth respondent in his letter dated 18.03.2016 submitted a report in respect of Rasta dispute clearly stating that a road is existing and the petitioners house is lying adjacent to the house of one A. Purushottam Raju and on verification of the spot it was noticed that the way to the petitioners house was blocked with fencing and a wall was also constructed obstructing the way to their house. After receipt of the said communication from the fourth respondent, the fifth respondent registered Crime No.47 of 2016 and investigated into the matter. Ultimately, he filed a charge sheet before the Judicial Magistrate of First Class, Rajampet on 15.04.2016. It is also stated that the respondent police removed the wall with the help of revenue authorities, MDO, Rajampet which was constructed by the sixth respondent by complying with the proceedings of the Tahsildar, Rajampet dated 18.03.2016.
In view of the same, no further orders are required in the present Writ Petition and the Writ Petition is, accordingly, closed. However, it is open to the petitioners to take appropriate civil proceedings if they are still aggrieved with any land dispute. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
