Since all these criminal petitions are filed seeking modification of the orders passed by various Courts in respect of different crimes registered against the petitioner in different Police Stations of Kadapa and Anantapur Districts, they are heard together and disposed of by this common order.
The present Criminal Petitions are filed seeking modification of the orders passed by various Courts in Kadapa and Anantapur Districts, while releasing the petitioner/Accused on bail on certain terms and conditions.
By order dated 01.10.2015 passed in Crl.M.P.No.8804 of 2015 in Crime No.12 of 2015 of Renigunta (U) Police Station, on the file of V Additional Judicial Magistrate of First Class, Tirupati, Chittoor District, the petitioner was directed to report before the S.H.O. concerned on every Monday and Thursday between 7.00 a.m. and 2.00 p.m. for a period of two months or till filing of charge sheet; (2) In Crl.M.P.No.1898 of 2015,
(relating to Crime No.64 of 2015 of Sidhout Police Station), on the file of Judicial Magistrate of First Class, Sidhout, Chittoor District, the petitioner was directed to report before the said Court on every working Friday between 10.30 a.m. and 1.00 p.m. for a period of two months or till filing of charge sheet, whichever is earlier; (3) by order dated 19.08.2015 passed in Crl.M.P.No.630 of 2015 in Crime No.142 of 2014 of Puthalapattu Police Station, on the file of III Additional Munsif Magistrate of Chittoor, the petitioner was directed to report before the S.H.O. concerned on every Monday without fail till filing of charge sheet; (4) Similarly in Crl.M.P.No.490 of 2015 (Crime No.118 of 2014 of Pullampet Police Station, Kadapa District) the learned III Additional District and Sessions Judge, Rajampet, Kadapa District, directed the petitioner to report before the S.H.O. concerned on every Thursday and Saturday between 2.00 p.m. to 5.00 p.m. until further orders;
(5) In Crl.M.P.No.629 of 2015 filed under Sections 437 and 439 of Cr.P.C., seeking release in Crime No.102 of 2014 of Puthalapattu Police Station, on the file of III Additional Munsif Magistrate of Chittoor, the petitioner was directed to report before the S.H.O. concerned on every Monday without fail till filing
of charge sheet; and (6) by order dated 19.08.2015 passed in Crl.M.P.No.1909 of 2015 in Crime No.50 of 2015 of V. Kota Police Station, on the file of Principal District and Sessions Judtge, Chittoor District, the petitioner was directed to report before the S.H.O., V.Kota, thrice in a week i.e., on Tuesday, Thursday and Saturday at any time in between 11.00 a.m. and 1.00 p.m. for a period of two months or till filing of charge sheet, whichever is earlier.
In view of the above, learned counsel for the petitioner/Accused mainly submits that it is practically impossible for the petitioner to report before different Police Stations at the same time. Having regard to the nature and gravity of the offence, the learned Public Prosecutor submits that the petitioner may be directed to report in the office of the Deputy Inspector General of Police, Anantapur, everyday, except on the dates when his presence is required before the Court concerned.
Having regard to the facts and circumstances mentioned above, the conditions imposed in the aforesaid orders is hereby modified by directing the petitioner to report in the office of the Deputy Inspector General of Police, Anantapur, everyday, except on the dates when his
presence is required in any of the Courts, which should be informed to the person concerned in the office of the D.I.G., Anantapur, in advance.
Accordingly, all these Criminal Petitions are disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
