ORDER:

This w rit petition i s filed f o r a mandamus t o set aside proceedings bearing Rc.No.265/2009 (B), dated 28.08.2009, of the respondent, whereby he has suspended the petitioner's fair price shop authorisation of Shop No.25 of Mudigubba Village and Mandal,

Anantapur District.

This Court by order, dated 08.09.2009, granted interim suspension of the impugned order.

At the hearing, the learned Assistant Government Pleader for Civil Supplies (AP) submitted that in pursuance of the said interim order, the petitioner's fair price shop authorisation has been restored and that in view of the pendency of this writ petition, the respondent has not completed the enquiry and passed a final order. As the scope of this writ petition is confined to suspension of the petitioner's fair price shop authorization pending enquiry, I do not find any justification for the respondent in not completing the enquiry and passing a final order. The respondent is, therefore, directed to complete the enquiry and pass a final order, as expeditiously as possible and not later than two months from the date of receipt o f a copy of this order, and take further action depending upon the nature of the order he may pass.

Subject to the above direction, the writ petition is disposed of. As a sequel to disposal of the writ petition, W.P.M.P.Nos.24537, 24538 & 24539 of 2009 shall stand disposed of as infructuous.
