THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7251 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime No.153 of 2023, on the file of Narayanpet Police Station, Narayanpet District, registered for the offences under Sections 498-A, 304-B r/w. 34 of IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

Petitioner's wife committed suicide by hanging herself at her parent's house. The brother-in-law of the petitioner lodged a complaint stating that the marriage of the petitioner with the deceased was performed in the month of May, 2022. However, this petitioner and his parents/mother-in-law and father-in -law were harassing the petitioner for additional dowry of Rs.2,00,000/-. She was tortured physically and
mentally. Unable to bear the harassment, she committed suicide.

On instructions, learned Additional Public Prosecutor would submit that 17 witnesses have been examined and most part of the investigation is complete.

Learned counsel for the petitioner would submit that similar allegations were made against A-2 and A-3 who were already enlarged on bail.

Keeping in view that most part of the investigation is complete, this Court deems it appropriate to direct release of the petitioner on bail subject to following conditions: i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties for a like sum each to the satisfaction of Judicial Magistrate of First Class , Narayanpet.
ii) The petitioner after release shall appear before the concerned Station House Officer every Monday for a period of eight weeks or until filing of charge sheet, whichever is earlier at 10.00 AM and thereafter as and when required, for the purpose of investigation.
iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 7.
Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, pending if any, shall stand closed.
