HON'BLE SRI JUSTICE R. KANTHA RAO WRIT PETITION NO. 21642 OF 2015 ORDER:

This Writ Petition is filed challenging the action of the respondents in not paying the half pay leave as per proceedings dated 28.3.2013 of the 3rd respondent as illegal and arbitrary and consequently direct the respondents to pay the half pay leave in terms of the proceedings dated 28.3.2013 of the 3rd respondent.

The case of the petitioner is that she worked as B.Ed Assistant in K.P.D.T High School, Ashok Nagar at Eluru for a period of 29 years and retired from service on 31.10.2012. It is submitted that vide proceedings in Rc.No. 2177/D3/2013 dated 28.3.2013 sanction of encashment of earned leave and half pay leave was grated to the petitioner and three others. Petitioner is shown at serial No. 2 and the amount, which was sanctioned towards leave encashment, is mentioned as Rs. 2,04,418/-.

It is submitted that the petitioner submitted representation to the District Educational Officer-third respondent herein, on 19.8.2014 and also to the Commissioner and Director of School Education, Nampallysecond respondent herein, on 10.11.2014 in this regard, but so far amounts of encashment of earned leave and half pay leave have not been granted to the petitioner. It is her further

grievance that even though the amounts relating to encashment of earned leave and half pay leave has been released to other persons mentioned in the proceedings, the petitioner was not paid the amounts inspite of repeated representations.

Learned counsel appearing for the respondents submitted that the 5th respondent herein also sent a letter to the third respondent to pay arrears of encashment of earned leave and half pay leave to the petitioner as well as to the other persons to whom the amounts have become due. Considering the submissions made by the learned counsel on either side, the Writ Petition is disposed of at the stage of admission directing the respondents 2 & 3 to sanction and pay the amounts relating to arrears of leave encashment of earned leave and half pay leave to the petitioner in terms of proceedings dated 28.3.2013 of the third respondent, subject to her entitlement, within a period of eight weeks from the date of receipt of a copy of this order.

As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
