.I and Crl.P.No.5825 of 2019 COMMON ORDER The criminal petition is filed under Section 482 Cr.P.C., seeking to quash the proceedings in P.R.C.No.200 of 2019 on the file of VII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, registered for the offences under Sections 420, 352 354-A, 354-D, 506, 376 read with Section 511 IPC, against the petitioners/A2 and A3.

2.

I.A.Nos.2 and 3 of 2019 are filed under Sections 320(6) and 320(2) of Cr.P.C., by both parties seeking leave of this Court to compound the offences and to record compromise as the matter was settled out of the Court. Along with the affidavits, they filed a joint memo of compromise stating that the 2nd respondent lodged a complaint against A1 and the petitioners, based on which, aforesaid crime was registered against them, and after investigation, charge sheet was filed against A1 to A3 and the same was numbered as P.R.C.No.200 of 2019. It is stated that the de-facto complainant took divorce from her husband due to severe and unconditional survival and thereafter, she joined as computer operator in the office of A1 and while working in the said aadhar centre, upon a complaint of a citizen, a case was registered against her and A1 and then, she left the job, but A1 used to sent indecent messages to her phone and attempted to commit sexual assault on her. However, during pendency of the PRC proceedings, at the advice of the elders and

well-wishers, the de-facto complainant wants to withdraw the present complaint against the petitioners/A2 and A3 without any coercion, force or undue influence.

3.

Today, when the matter came up for hearing, the 2nd respondent/de-facto complainant and the petitioners/A2 and A3 are present and they are identified by their respective counsel. They filed xerox copies of their aadhar cards before this Court. When this Court enquired the parties, the de-facto complainant and the petitioners/A2 and A3 stated that they entered into compromise due to intervention of the elders.

4. In view of the settlement arrived at between the parties, I find that it is a fit case to record compromise between parties and to quash the proceedings against the petitioners/A2 and A3.

5. In the result, I.A.Nos.2 and 3 of 2019 are ordered. Consequently, the Criminal Petition is allowed and the proceedings in P.R.C.No.200 of 2019 on the file of VII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, are hereby quashed against the petitioners/A2 and A3.

6. Miscellaneous petitions, if any pending in the criminal petition, shall stand closed.
