In this writ petition, petitioner challenges notice, dated 06.09.2019, issued by respondent No.4-Mandal Revenue Officer, Bahadurpura Mandal, Hyderabad, under Section 7 of the Land Encroachment Act (for short 'the Act'), to show cause as to why she shall not be evicted from the land to an extent of 214 square yards in TS.No.14, Block-I, Ward No.234 of Shaher-E-Hyderabad. The petitioner asserts that her husband is the owner of the subject land and after his death, her sons constructed a shed therein, which was assigned Municipal No.20-7-462/1, and leased out the same to one Mohd.Yousuf for carrying on scrap business. She filed photographs evidencing the same. She also asserts that in response to the impugned notice, she submitted her explanation on 09.09.2019.
Learned Government Pleader for Revenue appearing for the respondents submits that as the petitioner had submitted explanation in response to the impugned notice, the same will be taken into consideration by respondent No.4 and appropriate orders will be passed under Section 6 of the Act.
Perused the material on record. It is not in dispute that the petitioner was issued the impugned notice, for which, explanation dated 09.09.2019 was submitted. In the circumstances, respondent No.4 shall consider such explanation and pass a reasoned order
under Section 6 of the Act. Till such time, the respondent authorities shall not dispossess the petitioner from the subject property. The writ petition is disposed of accordingly.
