HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.8352 of 2015 ORDER:
This Writ Petition is filed with the averment that the petitioner purchased land admeasuring Ac.0.083⁄4 cents in Sy.Nos.1/2, 2/1 (part) (Old Sy.No.33) situated at Akkayapalem, Visakhapatnam District. The petitioner states that, as his name was recorded in the revenue adangal copies, the Tahsildar issued a certificate dated 13.02.2013 to the effect that the subject land belongs to him. While so, respondent Nos.4 and 5 erected panshops in the subject land and got power supply vide service connection Nos.9175 ad 20450 from the third respondent. When the officials of the third respondent tried to disconnect power supply, respondent Nos.4 and 5 filed C.C.No.112 and 113 of 2013 before the District Consumer Forum at Srikakulam. By order dated 02.07.
2013, the Consumer Forum directed the official respondents not to disconnect the power supply to service connection Nos.9175 ad 20450. In the said C.C., the petitioner was not made a party. However, the petitioner submitted representations dated 29.12.2014 and 08.06.2012 seeking indulgence of the official respondents for disconnection of power supply as the land does not belong respondent Nos.4 and 5. As the said representations were not considered and disposed of, the present Writ Petition is filed.
In the above circumstances, this Court is not inclined to keep the Writ Petition pending. The second respondent is directed to consider the representations submitted by the petitioner on 29.12.2014 and 08.06.2012, after issuing notice to respondent Nos.4 and 5 and the petitioner, and pass necessary orders, in
accordance with law, within a period of sixty days from the date of receipt of a copy of this order.
The Writ Petition is, accordingly, disposed of. As a sequel thereto, miscellaneous applications, if any, also stand disposed of.
