THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.17404 of 2009 ORDER:
When the matter is taken up for hearing, it is brought to the notice of this Court that the petitioner expired during pendency of this Writ Petition.

This Writ Petition is filed by the petitioner challenging the order, dated 15.04.2009, passed by the Industrial Tribunal in I.D.No.117 of 2006, whereunder no relief was granted to the petitioner and the petitioner is seeking consequential relief to reinstate him into service as Conductor. Since the petitioner expired, the consequential direction of reinstate him into service as Conductor would not arise. However, the respondents are directed to pay the service benefits of the deceased employee, for the service rendered by him with the respondent-Corporation, from the date of his initial appointment till the date of his removal, if not already paid, be paid to the legal representatives of the deceased employee, within a period of four (4) weeks from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. Miscellaneous petitions pending if any, shall stand closed. There shall be no order as to costs.
