HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.9042 of 2017 ORDER:

This writ petition is filed praying to grant the following relief: "to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus to (1) Set aside the charge Memo No.2288/TS/IT/2015-2, dated 28-06-2016 as wholly illegal, arbitrary and violative of Articles 14 and 15 of Constitution of India, (2) direct the Respondents to declare the probation of the petitioner to the post of Regional Transport Officer and consequently direct the Respondents to grant all consequent benefits including seniority etc., in the interest of justice."

When the matter is taken up for consideration, learned counsel for petitioner as well as learned Government Pleader submit that since charge memo was already issued and explanation was submitted by the petitioner long ago, direction be issued to the respondents to conclude the disciplinary proceedings as expeditiously as possible and that would suffice the interest of the petitioner.

Without expressing any opinion on merits on the contentions urged, writ petition is disposed of directing the Transport Commissioner to take expeditious steps by strictly complying with the requirements of Andhra Pradesh Civil Services (Classification, Control and Appeal) Rules, 1991 and complete the disciplinary proceedings by fixing time schedule. Petitioner shall also cooperate for the early conclusion of the proceedings. Subject to petitioner cooperating and participating in the enquiry, the entire disciplinary

proceeding should be concluded within a period of four months from the date of receipt of copy of this order. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ___________________________ JUSTICE P.NAVEEN RAO kkm
