HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.20186 of 2019 ORDER:

This writ petition is filed seeking the following relief :- " ........ to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus by declaring the entire action of the respondents (1) in not sending for 9 months Training course for the purpose of appointing the petitioners as constables in TSSPF, even though they are selected in pursuance of notification issued by the 4th respondent during December 2011 and also not finalizing the proposals submitted by the 2nd and 3rd respondents vide Rc.No.142/ Rect/ Genl.1/ 2017 dated 4.1.2018 and Rc.No.Spf/ A2119/ Probn./ 2018 dated 6.3.2018 to the 1st respondent for the purpose of according necessary permission to send the petitioners herein for the Induction Training at TSSPF Academy, Ameenpur, as highly illegal, arbitrary, unjust, improper, violative of all principles of natural justice

(2) and further to hold that the petitioners herein are entitled for seniority and other allied benefits on par with their batch mates such as who appeared and selected along with the petitioners in pursuance of notification issued by the 4th respondent during December 2011 on the ground that there is delay on the part of the respondents in process of selection in respect of the petitioners (3) and consequently to direct the respondents to forthwith send the petitioners herein for 9 months Induction training and to appoint them as Constables in TSSPF if necessary by duly according permission as per proposals sent by the 2nd and 3rd respondents vide Rc.No.142/ Rect/ Gen1.-1/ 2017 dated 4.1.2018 and Rc.No.Spf/ A2-119/ Probn./ 2018 dated 16.3.2018 to the 1st respondent with all consequential benefits on par with their batch mates ......"

Heard Mr.S.Satyanarayana Rao, learned counsel for the petitioners, learned Government Pleader for Home for the 1st respondent and Sri M.V.Rama Rao, learned Standing Counsel for respondents 2 to 4.

It has been contended by the petitioners that they were selected pursuant to Notification issued by the 1st respondent during December, 2011. The petitioners submit that they could not complete nine months training programme either on account of ill-health or various other factors. The petitioners submit that they have been requesting the respondents to send them for the training

programme along with the newly recruited candidates, but their cases were not considered by the respondents. The petitioners submit that on 04.01.2018 and 06.03.2018 respondents 2 and 3 have recommended their cases to the 1st respondent for sending them to the nine months training at TSSPF Academy, Ameenpur, Sangareddy District. But, the 1st respondent is not passing any orders on the proposal submitted by respondents 2 and 3. Therefore, the learned counsel submits that appropriate orders be passed in the writ petition directing the 1st respondent to pass appropriate orders on the proposal submitted by respondents 2 and 3 on 04.01.2018 and 06.03.2018.

Learned Government Pleader and the learned Standing Counsel appearing for the respondents have contended that appropriate orders be passed in the writ petition directing the 1st respondent to pass appropriate orders on the recommendations submitted by respondents 2 and 3 on 04.01.2018 and 06.03.2018. This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the 1st respondent to pass appropriate orders on the proposal submitted by respondents 2 and 3 on 04.01.2018 and 06.03.2018 in accordance with law within a period of four weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
