This Petition coming on for hearing, upon perusing the Memorandum of Grounds of criminal Petition and upon hearing the arguments of sri VALLURU PADMA ,Advocate for the Petitioner and the Assistant public prosecutor (TG/Ap) on behalf of the Respondent.

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C') seeking bail to the petitioner who is arrayed as Accused No.8 in the event of his arrest in Crime Nc.121 of 2022 on the file of Station House Officer, Afzalgunj Police Station, Hyderabad registered for the offence punishable under Section 8(C) read with Section 2O(b)(ii)(B) and 27(b) ot NDPS Act.

Hearc learned counsel for the petitioner/Accused No.8 and learned Assistant Public Prosecutor for the respondent-State. Perused the: record.

Learrred counsel for the petitioner submits that this petitioner is arrayed rs Accused No.B. However, he was arrested and released on bail in another crime No.102 of 2022 for the offence under Section B{c) read with Section 2O(bXiiXB) and Section 27(b) ot NDPS Act, 1985 on the file of Nallakunta Police Station, Hyderabad. t

Crl.Petition No.6472 of 2022 He further submits that the other Accused Nos.1 to 7 were already released on bail.

4. Since it is stated that the petitioner/Accused No.8 was arrested and released on bail in another Crime No.102 of 2022, this Court is not inclined to grant the relief of anticipatory bail to this petitioner in this case.

Accordingly, the petitioner/Accused No.8 shall surrender before the concerned Court within one week from the date of receipt of a copy of this order and file application seeking bail with due service to the Public Prosecutor. Upon such filing, the concerned Court shall dispose of the bail application, on merits, keeping in view the fact that the other Accused Nos.1 to 7 were already released on bail, on the very same day after giving opportunity of hearing to the Public Prosecutor.
